Four companies have been denounced by the COGITI for infractions in the matter of energy certification.
We are not talking about something new, since a few months ago different companies of dubious reputation were offering energy certificates at low prices, eliminating costs in their drafting by taking data from the certificate, it was proposed and proposed in different offers that you can track in the network that the client becomes the person in charge of the data collection. The Report is drawn up by the Competent Technician and the data is collected by the client / owner who becomes recognized as an Assistant Technician who is the one who captures and obtains the information and characteristics of the property, that is:
Competent Technician = Technician with a University Degree authorized according to Law 235/2013.
Assistant Technician = Becomes the Client / Owner of the apartment.
The complaint states … «What the corresponding companies or professionals offer is, pure and simple, that the client is the one who provides the data or photographs of the building, or the part of it that is going to be the subject of the certification, at their own discretion. All this, therefore, without the slightest guarantee of the veracity of the data and images provided ».
Almost a month ago we started through this portal an intention to report some dubious practices offered by different companies in the sector, losing ourselves in the administrative bureaucracy without reaching any conclusion or any specific point where we could formalize a complaint (You can access the article Denunciation of energy certificates) Since then, we already glimpsed the need for a forced involvement of different organizations or high-ranking entities that had the "power" necessary to be able to clarify and serve as a guide to an infraction in the energy certificate.
It should be noted that the complaint presented by the COGITI (General Council of Industrial Technical Engineering) is before the competent administrative body of the Autonomous Community in matters of energy certification of buildings, as indicated in Law 235/2013Basic Procedure for the Certification of the Energy Efficiency of Buildings This will be the body in charge of the supervision and correct application thereof.
From what we have been able to verify so far, from our humble opinion in the majority of Communities - if not all - the infractions committee in Energy Certification has not yet been formalized within the corresponding body, so they will send us to write a letter to the Corresponding Territorial Delegation to proceed with its study.
We hope that from the initiative of COGITI other entities and organizations will join so that together we can see that the administration begins to take seriously its responsibility and duty in compliance with the Law as well as clarify and formalize the necessary means to proceed with the application. of the corresponding infractions.
