
Royal Decree 390/2021
It's been a long time since we wrote about the famous energy certificates for homes and other types of properties. Mainly, because the changes are more at the level of Software updates to make the reports, and, less, in relevant regulations.
The reports of the Energy Efficiency Certificate collect - mainly - the most important information about the energy situation of a property and its "performance." So we address an important issue about energy efficiency.
The Council of Ministers of Spain, at the proposal of the Ministry of Transport, Mobility and Urban Agenda (Mitma) and the Ministry for the Ecological Transition and the Demographic Challenge (Miteco) has approved the new Royal Decree 390/2021 about him basic procedure for the certification of the energy efficiency of buildings.
But … What regulations does this Royal Decree affect?
- Repeals the famous Royal Decree 235/2013, of April 5, which approves the basic procedure for the certification of the energy efficiency of buildings (Remember that this was modified by Royal Decree 564/2017).
- Modifies the art. unique. 31 of Royal Decree 178/2021, of March 23.
- Modifies the arts. 5.1, 7.b), 8.1.b) and Annex I of the Royal Decree 56/2016, of February 12.
- Modifies IT 1.2.4.1.2.1 of the Regulation approved by Royal Decree 1027/2007, of July 20.
- Partially transposes Directive (EU) 2022/844, May 30.
If you look closely, whenever there have been changes in the energy certificate legislation, it is due to the need to comply with European regulations. Not to create a better system that truly adds value, both to technicians and consumers. But this is another debate.
And now with the new Royal Decree 390/2021… Do I have to report differently? Well, being tell you no. But you will have to take into account the main changes that affect the certification of buildings:
1. Extension of the obligation before compulsory certification
- Mandatory reporting for those buildings with a total useful area greater than 500 m2 and intended for administrative, commercial, health, public residential, educational, cultural, recreational, hotel or sports use.
- Mandatory reporting on buildings occupied by a public administration with a total useful area greater than 250 m2, regardless of the frequency and influx of public in it.
- Obligation to make a report on those properties that must pass the Technical Building Inspection (ITE) and energy renovations in the coming years (This is already true in many Autonomous Communities if you wanted to access subsidies).
* You have to check exactly Article 8 (Page 10) that there are exceptions and others.
2. Improvement of procedures and updating
- Finally! The new Royal Decree regulates the obligation to carry out, at least, a face-to-face visit to the property with a maximum notice of three months before the issuance of the certificate.
This visit will allow to carry out the data collection, tests and checks necessary for the correct completion of the energy efficiency certificate
3. Deadline for submitting the certificate to the competent body.
- Now him building's energy performance certificate, together with the building's energy evaluation report in electronic format (XML) must be submitted within a month from its date of issue (if the autonomous community does not establish another term).
By the way. The Technical Code has a tool for XML format. This application facilitates the use of energy evaluation reports in electronic format, for their verification, visualization and editing that we can see from HERE.
The Royal Decree speaks in its article 7 of "Centralized Administrative Registry". We will see what happens with the issue of registration by autonomous community when we talk about the IEE Building Evaluation Reports (Remember that, in some communities, as a possibility, they have their own registry and not the centralized one)
4. Validity of the Energy Efficiency Certificate report
- The energy efficiency certificate will have a maximum validity of ten years, except when the energy rating is G, whose maximum validity will be five years.
Keep in mind that this new regulations come into force on 06/03/2021 so the presentation of the; building energy performance certificate + building energy evaluation report should already be in XML format.
